Terms of service

Overview

This website is operated by Shelley Christie Melbourne. Throughout the website, the terms “we”, “us” and “our” refer to Shelley Christie Melbourne.

Shelley Christie Melbourne offers this website, including all information, products, features and services available through it, to you subject to these Terms and Conditions.

Our online store is powered by Shopify, which provides the ecommerce platform that allows us to offer our products to you.

By visiting our website, browsing our products or placing an order, you agree to these Terms and Conditions together with our:

  • Privacy Policy;
  • Returns and Refund Policy; and
  • Shipping and Delivery Policy.

Please read these policies carefully before using the website or purchasing from us.

Nothing in these Terms and Conditions excludes, restricts or limits any rights or remedies available to you under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

1. Eligibility and use of the website

By using this website or placing an order, you confirm that:

  • you are at least 18 years old or have permission from a parent or legal guardian;
  • the information you provide is accurate, current and complete;
  • you are authorised to use the payment method provided; and
  • you will use this website only for lawful purposes.

You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious software or interfere with its operation or security.

We may refuse or restrict access to the website where we reasonably believe it is being misused.

2. Handmade products

Shelley Christie Melbourne creates handmade earrings, flowers, headwear and millinery pieces.

Because our products are handmade, slight variations may occur in:

  • colour;
  • shape;
  • texture;
  • finish;
  • placement;
  • pattern; and
  • size.

These minor variations form part of the individual nature of a handmade piece and are not necessarily considered faults.

We take reasonable care to describe and photograph products accurately. However, colours and product appearance may vary slightly depending on screen settings, lighting and the device used to view the website.

Nothing in this section limits your rights where an item is faulty, significantly different from its description or otherwise fails to meet a consumer guarantee under Australian Consumer Law.

3. Product availability

Products may be available in limited quantities because they are handmade or individually sourced.

We may:

  • limit the quantity of a product available for purchase;
  • withdraw or discontinue a product;
  • update a product description;
  • correct an error; or
  • decline an order where stock is unavailable.

We will not make a material change to an accepted order without contacting you.

If we are unable to supply a product you have paid for, we will contact you and provide an appropriate refund or alternative option.

4. Orders

When you submit an order, you are making an offer to purchase the selected products.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted.

An order is accepted once payment has been successfully processed and we confirm that the order can be fulfilled.

We may reasonably decline or cancel an order where:

  • an item is unavailable;
  • incorrect pricing or product information was displayed;
  • payment cannot be processed;
  • we reasonably suspect fraudulent activity;
  • an order breaches purchase limits; or
  • delivery to the selected location is unavailable.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

5. Order details and cancellations

Please review your order carefully before submitting it, including:

  • the selected product;
  • colour and size;
  • personalisation details;
  • quantity;
  • email address; and
  • delivery address.

Contact us as soon as possible if you notice an error.

We will try to accommodate changes or cancellation requests, but changes may not be possible once an order has entered production, been customised, packaged or dispatched.

Custom-made, personalised and altered orders generally cannot be cancelled after work has commenced unless required by law.

6. Custom and made-to-order pieces

Custom, personalised and made-to-order pieces will be created according to the details agreed between you and Shelley Christie Melbourne.

You are responsible for checking that any measurements, colours, wording, event dates and design instructions you provide are correct.

Production and completion timeframes are estimates unless a particular date has been expressly agreed in writing.

Because custom pieces are created specifically for the customer, they are not eligible for change-of-mind returns or exchanges. This does not affect your rights where the item is faulty, does not match the agreed specifications or fails to meet another consumer guarantee.

Full payment must be received before a custom order is dispatched unless another arrangement has been confirmed in writing.

7. Prices and payment

All prices are displayed in Australian dollars unless otherwise stated.

The price charged will be the price displayed at checkout when the order is submitted, subject to correction of genuine errors.

Shipping costs, Express Post charges and any other applicable charges will be shown at checkout before payment.

International customers may also be responsible for customs duties, taxes and import charges imposed by their destination country.

We reserve the right to change product prices at any time. A price change will not affect an order that has already been accepted, except where there has been an obvious pricing error.

Payment must be made using one of the methods offered at checkout.

8. Promotions and discount codes

Promotions and discount codes may be subject to additional conditions displayed at the time of the offer.

Unless otherwise stated:

  • promotions cannot be combined;
  • discount codes must be applied at checkout;
  • discounts cannot be applied retrospectively;
  • promotions are available only during the stated period; and
  • promotions are subject to product availability.

We may correct or cancel a promotion where it has been published in error. We will not cancel an accepted order solely because a promotion later ends.

9. Gift cards

Where gift cards are offered, they are subject to any conditions displayed at the time of purchase.

Gift cards cannot be exchanged for cash except where required by law.

Customers are responsible for keeping gift-card details secure. Please contact us promptly if you believe a gift card has been used without permission.

Applicable expiry periods and other gift-card requirements will comply with Australian law.

10. Shipping and delivery

Orders are processed, dispatched and delivered in accordance with our Shipping and Delivery Policy.

Delivery dates and Australia Post transit times are estimates rather than guaranteed arrival dates unless we have expressly agreed otherwise in writing.

We will provide reasonable assistance with delayed, missing or damaged parcels.

Customers are responsible for providing a complete and accurate delivery address. Additional delivery costs may apply where an order is returned because an incorrect or incomplete address was supplied.

Nothing in this section excludes our responsibilities under Australian Consumer Law.

11. Returns, refunds and consumer guarantees

Returns, repairs, replacements and refunds are managed in accordance with our Returns and Refund Policy and Australian Consumer Law.

We do not provide returns or exchanges merely because a customer changes their mind, orders the wrong product or decides they no longer want an item.

However, our products come with guarantees that cannot be excluded under Australian Consumer Law.

Where a product does not meet a consumer guarantee, you may be entitled to a repair, replacement, refund or another remedy depending on the nature of the problem.

Our Returns and Refund Policy operates in addition to your rights under Australian Consumer Law and does not replace or restrict those rights.

12. Care and use of products

Customers should follow any care, handling and storage information supplied with a product or displayed on the website.

Damage caused by misuse, accidental damage, incorrect storage, alterations, improper cleaning or normal wear and tear is not considered a manufacturing fault.

Our headwear, millinery pieces, flowers and earrings may include delicate components. They should be handled carefully and stored away from excessive moisture, heat, pressure and direct sunlight.

Products should only be used for their intended purpose.

13. Intellectual property

Unless otherwise stated, the content on this website is owned by or licensed to Shelley Christie Melbourne. This includes:

  • the Shelley Christie Melbourne name and branding;
  • product designs;
  • photographs;
  • artwork;
  • graphics;
  • written descriptions;
  • videos; and
  • website content.

You may view the website and print or save information for your personal, non-commercial use.

You must not copy, reproduce, modify, distribute, publish, sell or commercially use our content or product imagery without prior written permission.

Purchasing a product does not transfer ownership of any intellectual-property rights relating to the product design, photographs or branding.

14. Customer reviews and submitted content

Where you submit a review, photograph, comment or other content, you confirm that:

  • the content is truthful and based on your genuine experience;
  • you own the content or have permission to submit it;
  • it does not infringe another person’s rights;
  • it does not contain unlawful, abusive or misleading material; and
  • it does not contain malicious code or spam.

You give Shelley Christie Melbourne permission to display and reproduce submitted reviews and related content for the operation and promotion of the business.

Where practicable, we will seek permission before using a customer’s identifiable photograph prominently in advertising or social-media promotions.

We may remove content that is unlawful, misleading, offensive, irrelevant or infringes another person’s rights.

15. Third-party services and links

Our website may contain links to or use services provided by third parties, including Shopify, payment processors, Australia Post and social-media platforms.

Third-party websites and services operate under their own terms and privacy policies.

We are not responsible for the content or practices of an independent third-party website. However, this does not remove any responsibility we have for products purchased directly from Shelley Christie Melbourne.

16. Shopify

Shelley Christie Melbourne’s online store is powered by Shopify.

Purchases made through this store are transactions between the customer and Shelley Christie Melbourne. Shopify provides the ecommerce platform but is not the seller of Shelley Christie Melbourne products.

Shopify may collect and process personal information in connection with its operation of the platform. Further information is provided in our Privacy Policy and Shopify’s applicable privacy information.

17. Privacy

Personal information collected through the website is handled in accordance with our Privacy Policy.

Information may be provided to service providers where reasonably necessary to:

  • process payments;
  • fulfil and deliver orders;
  • operate the Shopify store;
  • communicate with customers;
  • provide customer service; and
  • comply with legal obligations.

Please review our Privacy Policy for further information about how personal information is collected, used, stored and disclosed.

18. Website information and errors

We take reasonable care to keep website information accurate and current.

Occasionally, the website may contain an error relating to:

  • a product description;
  • price;
  • availability;
  • promotion;
  • image;
  • shipping charge; or
  • delivery estimate.

We may correct an error and update the relevant information.

Where an error materially affects an order, we will contact you and provide an opportunity to proceed on the corrected basis or receive a refund.

19. Website availability

We do not guarantee that the website will always be available, uninterrupted or free from technical issues.

We may temporarily suspend or restrict access for maintenance, security, updates or circumstances outside our reasonable control.

To the extent permitted by law, we are not responsible for losses caused solely by temporary website unavailability where we have exercised reasonable care.

Nothing in this section excludes liability that cannot lawfully be excluded.

20. Limitation of liability

To the extent permitted by law, Shelley Christie Melbourne is not liable for indirect or consequential loss that was not reasonably foreseeable and did not result from our failure to comply with a legal obligation.

Nothing in these Terms and Conditions excludes, restricts or modifies:

  • the consumer guarantees under Australian Consumer Law;
  • liability for fraud or wilful misconduct;
  • liability for personal injury caused by negligence where it cannot lawfully be excluded; or
  • any other right, remedy or liability that cannot legally be excluded.

Where our liability can lawfully be limited, it will be limited only to the extent permitted by applicable law.

21. Severability

If any part of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that part will be removed or limited to the minimum extent necessary.

The remaining terms will continue to apply.

22. No waiver

If we do not immediately enforce a right under these Terms and Conditions, this does not mean that we have waived that right.

23. Governing law

These Terms and Conditions are governed by the laws of Victoria, Australia.

You and Shelley Christie Melbourne submit to the courts and tribunals of Victoria and any courts that may hear appeals from them.

Nothing in this section prevents a customer from exercising any rights available under applicable consumer law.

24. Changes to these terms

We may update these Terms and Conditions from time to time to reflect changes to our website, products, business practices or legal obligations.

The current version will be published on this page with the date it was last updated.

Changes will apply from the date they are published and will not retrospectively alter an order that has already been accepted, unless required by law or agreed with the customer.

Last updated: July 2026
